Villa EMG Terms & Conditions – Short-Let Stays in Germany

1. Contract & Applicability

1.1 These Terms & Conditions (“T&Cs”) govern all short-term rental agreements concluded between EMG-Creation GmbH, trading as VillaEMG.com (“Host”), and the individual(s) making a reservation (“Guest”).

1.2 By proceeding with a reservation, the Guest confirms having read, understood, and agreed to these T&Cs, as well as our Privacy Policy available at www.villaemg.com und www.firstglobalvillachain.com 

1.3 These T&Cs take precedence over any conflicting provisions in third-party platforms unless otherwise agreed in writing by the Host.

1.4 Supplementary agreements or amendments are only valid if confirmed in writing by the Host.

2. Booking, Deposit & Payment Terms

2.1 Reservations must be made in writing via email, WhatsaApp, our booking platform, or approved agents’ platforms.

2.2 An upfront payment equal to 100% of the total rental cost is required to confirm the booking.

2.3 The balance must be paid in full no later than 60 days before the check-in date. For bookings made within 60 days of arrival, full payment is due immediately.

2.4 Accepted payment methods include:

  • Bank transfer (IBAN/BIC details upon request),
  • Credit or debit card, PayPal, Stripe.
  • Approved cryptocurrency (e.g., USDC), subject to verification and AML compliance.

2.5 Guests are responsible for all bank or exchange charges. Payments must be made in EUR unless otherwise agreed.

2.6 Failure to make timely payment entitles the Host to cancel the booking and retain the deposit or to amend booking at its discretion.

3. Booking Confirmation & Invoicing

3.1 A booking becomes legally binding once the Host receives payment according to item 2.2. this T&C or a written confirmation via email or booking system is issued.

3.2 Invoices are issued electronically. For corporate bookings or special arrangements, an invoice may be provided upon request.

3.3 All guests must provide a valid form of identification before check-in. For group bookings, the lead guest shall act on behalf of all parties.

4. Cancellation & Amendments

4.1 Guest Cancellations must be submitted in writing. The following refund policy applies:

  • <60 days before arrival or no-show: No refund.

4.2 Changes to Booking Dates are subject to availability and may incur an administrative fee.

4.3 Substitutions of Guests must be approved by the Host in advance.

4.4 Host Cancellations: If the Host is unable to provide the accommodation due to unforeseen circumstances, a full refund or comparable replacement will be offered.

4.5 No refunds will be issued in cryptocurrency. Refunds for crypto bookings will be processed in EURO at the prevailing rate, less administrative costs.

5. Security Deposit (Sicherheitsleistung)

5.1 A refundable security deposit (security deposit / Kaution), which constitutes a security for the proper and full performance of the guest’s contractual obligations, is required. The amount is specified at the time of booking and property. The security deposit must be paid no later than 14 days prior to arrival. For bookings made within 14 days of arrival, full payment of the security deposit is due immediately.

The Guest acknowledges that certain breaches (including parties, disturbances, or smoking) may cause non-material damage, including reputational harm, regulatory risk, and jeopardising the continued operation of the property, which may justify retention of the security deposit.

5.2 The security deposit is held as a security against any claims arising from damage to the property, excessive or special cleaning, lost or missing items, breach of house rules (including behavioural obligations), unpaid services, contractual penalties, or other contractual violations. The security deposit does not constitute a payment for accommodation and is not considered a contractual penalty. 

The Guest agrees that the Host’s inspection findings and incident records shall constitute prima facie evidence of a house rule breach, unless the Guest proves otherwise. Any objections regarding deductions must be raised in writing within 7 days of notification. After this period, the deductions shall be deemed accepted.

5.3 The security deposit will be returned within 14 days after check-out, following inspection of the property, provided that no deductions are due. Any deductions will be communicated to the guest in writing. Guests agree that the owner/operator is entitled to offset any justified claims against the security deposit.

6. Check-In & Check-Out

6.1 Standard check-in: from 17:00 local time. 

6.2 Standard check-out: by 11:00 local time.

6.3 Early check-in or late check-out is subject to availability and may incur extra charges.

6.4 Self-check-in instructions may be provided where applicable.

6.5 Guests must notify the Host of late arrivals (after 20:00) at least 24 hours in advance.

7. House Rules

7.1 Quiet Hours: Strictly observed from 22:00 to 07:00.

7.2 Smoking: Prohibited indoors. Outdoor smoking is allowed in designated areas with proper disposal.

7.3 Pets: Only allowed with prior written approval. Additional cleaning charges may apply.

7.4 Events/Parties: Not permitted unless pre-approved in writing. Breach may lead to immediate eviction without any refund.

7.5 Cleaning: Basic cleaning is included. The Guest must leave the property tidy. Extra charges apply for:

  • Unsorted waste (handling fee)
  • Dirty grills
  • Unreasonable mess

7.6 Waste Disposal: Guests must separate recyclables in accordance with local regulations.

7.7 Furniture & Fixtures: Must not be moved. Damage from rearrangement will be charged.

7.8 Utilities: Please turn off lights, heating/cooling, and close windows when leaving the property.

7.9 Pool Use (if applicable):

  • No glass near the pool
  • Shower before entering
  • Do not use oils or lotions before swimming

7.10 These House Rules may be amended or supplemented at any time and may vary depending on the property.

8. Guest Responsibilities

8.1 The Guest is fully responsible for the property during the stay and must inform the Host of any issues or damages.

8.2 The number of guests must not exceed the limit stated at booking. Undeclared guests may incur additional charges or eviction.

8.3 Commercial activities, subletting, or photography/filming without consent are prohibited until agreed by Host in writings.

8.4 Guests must comply with all applicable local laws and community rules, House Rules.

8.5 The Host reserves the right to enter the property in case of emergency or suspected breach of contract, after reasonable notice when possible.

9. Services & Amenities

9.1 The Host is not liable for any disruption of services (Wi-Fi, electricity, water) due to circumstances beyond control.

9.2 Any third-party services (e.g., chefs, transfers) arranged on behalf of the Guest are subject to those providers’ terms. The Host is not liable for their performance.

9.3 Basic consumables (toilet paper, soap, etc.) are provided for arrival. Restocking mid-stay is the Guest’s responsibility unless otherwise agreed.

10. Liability & Insurance

10.1 The Host is not liable for personal injury, loss, or damage to property belonging to the Guest or third parties.

10.2 Guests are strongly advised to obtain personal travel insurance covering health, cancellations, and property liability.

10.3 Improper use of facilities or negligence resulting in damage or injury is the Guest’s responsibility.

11. Force Majeure

11.1 The Host shall not be liable for delays, cancellations, or non-performance arising from force majeure, including but not limited to:

  • Natural disasters
  • Governmental actions
  • Utility outages
  • Pandemics or health crises

12. Privacy & Data Protection

12.1 By booking with Villa EMG, the Guest consents to the collection and processing of personal data in accordance with GDPR.

12.2 Data is used for:

  • Booking management
  • Communication
  • Legal compliance
  • Marketing (if opted-in)

12.3 The Guest may request deletion or review of their data by contacting info@emg-creation.de.

13. Governing Law & Jurisdiction

13.1 These T&Cs shall be governed by and construed in accordance with German law.

13.2 Disputes shall be subject to the exclusive jurisdiction of the courts where the property is located.

By making a booking and/or checking into the villa, you confirm your agreement that the property is provided strictly for temporary private residential use. Events or commercial activities are not permitted without prior written consent. We accept no liability for any injury, accident, loss, or damage to personal belongings during your stay, except where caused by our proven negligence. All amenities and facilities are provided on an “as is” basis. While we make every effort to ensure their proper functioning, we cannot guarantee uninterrupted operation.

Where third-party service providers (such as cleaning, transfers, excursions, etc.) are engaged, responsibility for the quality of those services rests solely with the providers themselves. Guests are required to adhere to the house rules, which are communicated prior to or upon arrival; any breach may result in additional charges or termination of the rental without refund.

We also accept no responsibility for cancellation or changes to booking conditions due to force majeure events, including but not limited to natural disasters, epidemics, or government restrictions. We reserve the right to amend the content of this notice at any time; the version in force at the time of booking shall apply.

By finalising a reservation, the Guest confirms agreement with these Terms & Conditions.
